Brad and Lisa really worked hard for me with medical bills that exceeded what both my insurance and the responsible party’s insurance I wasn’t expecting anything maybe just to break even but I was pleasantly surprised that in the end I not only was going to have my medical bills covered but would be receiving a sizable amount.

How We Help The Injured in Arizona

Personal Injury cases are personally handled by attorney Brad Johnson. Brad understands that dealing with insurance companies can be frustrating, which is why we provide quality legal services to people injured through the negligence of another. We want to make what can be a complex legal process as simple and human as possible because we truly care about helping every client.

Car Accidents are the most common type of personal injury claim. Car accidents are often due to the negligence of one or both drivers. Drivers may be distracted, impaired, drowsy, or may be driving recklessly by tailgating, weaving in and out of traffic, or failing to yield to others on the road.

Dog bite Injuries can range from minor to extremely severe. Young children are often bitten in the face because their face is at the same level as the dog’s face. When a dog bite occurs, medical attention should be sought immediately. In Arizona, the owner of the dog is liable for the injuries, no matter if the dog has ever bitten before.

Motorcycle Accidents are like car accidents in that they are usually the fault of negligent driving. Motorcyclists are much more likely to receive severe injuries following an accident than those in the passenger vehicle because they have virtually no protection other than a helmet if worn.

Truck Accidents can leave devastation in their wake. Due to the sheer size difference between a truck and a passenger vehicle, those in the passenger vehicle are much more likely to receive catastrophic injuries or die from the collision. Truck accidents are more complex because there are potentially more liable parties. The truck driver could have caused the accident, or the trucking company may have hired an untrained driver or failed to perform a background check. The loading company could be responsible if shifting or falling cargo caused the accident. If the accident was caused by poorly maintained equipment, the maintenance company could be held liable, and if a defective truck part caused the accident, the manufacturer may bear liability.

Bicycle Accidents, like motorcycle accidents, can leave the bicyclist with grave injuries that take a very long time to heal. In some cases, a driver who hits a bicyclist may leave the accident scene, making collecting a settlement more difficult.

Pedestrian Accidents often involve the elderly or small children. The elderly may not be able to cross a road as quickly, ending up hit by a driver that is watching the light rather than the actual person in the crosswalk. Children may pull away from their parents and dart into traffic, so drivers must be especially vigilant on city streets. Any age pedestrian can be a victim of a pedestrian accident and will likely require a significant amount of medical care in the future.

Premises Liability Claims include slip and fall accidents, dog bites, etc. Any time you are injured due to a hazard on another’s property (and you are not trespassing), then the owner may be liable for your resulting injuries.

Slip and Fall Accidents are extremely common, both in public places and in the workplace. Many people think the injuries resulting from a slip and fall accident could not be all that serious. Still, they often are, sometimes even including traumatic brain injury or a spinal cord injury.

Wrongful Deaths are essentially personal injury claims in which the victim dies from their injuries. At that point, the decedent’s estate, spouse, children, or parents may be able to file a wrongful death claim to receive funeral expenses, future lost wages, loss of consortium, loss of parental care, and more.

Back and Spinal Cord Injuries can be especially grave, particularly when paraplegia or quadriplegia are involved. Such injuries can require a lifetime of care, costing well over a million dollars in medical expenses alone. Having a strong attorney on your side who can ensure you receive an equitable settlement is crucial in a spinal cord injury.

Top Questions About Personal Injury in Arizona

What Should I Do Following a Personal Injury Accident?

The specific type of personal injury you receive will dictate, to some extent, how you will proceed. Generally speaking; however, you should do the following after being injured through the negligence of another:

  • Call 911 for an auto accident, a slip, and fall accident, or a dog bite injury. Having a police report can be an invaluable resource, especially when proving liability for an auto accident.
  • Seek medical attention as quickly as possible. Even when you do not think your injuries are that severe, you should have a physician check you out. In many cases, the stress of the accident floods your body with adrenaline which can mask injury symptoms. After seeking medical attention, make sure you carefully follow your care plan and attend all follow-up visits.
  • If necessary, we can help you find a doctor that will not require payment until your claim is settled.
  • Take photos, both of your injuries and of the scene of the accident.
  • If there were witnesses to your accident and you are physically able, get their contact information.
  • When you are home, call your own insurance company if you were involved in an auto accident.
  • Write down a comprehensive narrative of what happened while it is still fresh in your mind. It can be easy to forget details that could potentially be important for your attorney to help build a strong personal injury claim on your behalf.
  • Keep a file that has all your medical expense receipts.
  • Contact an experienced Arizona personal injury attorney as quickly as possible so your rights and future will be properly protected.

Will My Personal Injury Case Go to Trial?

The vast majority of personal injury claims do not go to trial. Only about 5 percent of all personal injury claims will end up at trial. In most cases, negotiations between your attorney and the insurance company will go back and forth, with your attorney providing the evidence and documentation to support the settlement requested. In most cases, the negotiations will be successful, and there will be no need to go to trial. Cases that do go to trial can take a very long time because the courts are so backlogged with cases. Personal injury claims that go to trial can take from one to three years to settle. This is motivation for all parties involved to reach a mutually agreeable settlement amount.

How Much Does a Personal Injury Attorney Cost?

Personal injury attorneys seek justice through the legal system on the behalf of those injured through the negligence of another person or entity. Many Phoenix personal injury attorneys will take your case with no money upfront. If the attorney successfully recovers a settlement on your behalf, they are entitled to an agreed-upon percentage of the settlement. Any upfront costs that allowed the case to proceed will be deducted from the settlement; then, the attorney will deduct their portion. The “standard” for personal injury attorneys is 33.3 percent. At Brad Johnson Injury Law, we charge 25 percent of the settlement. This means you end up with more money in your pocket. We are motivated to secure the biggest settlement possible on your behalf.

Injured in Arizona, Now What?

What Compensation Might I Be Entitled to Receive Following My Personal Injury?

Special damages are those that are easily quantifiable—that is, easy to determine because there are receipts or other evidence of the cost. Medical expenses and lost wages fall into this category. Medical expenses can include hospital, ambulance, and ER costs, physician expenses, prescription drug expenses, expenses for rehabilitative therapies, surgical costs, and even travel expenses (gas, motel, meals) if you have to travel a significant distance to see a specialist.

Lost wages are equally easy to determine—whatever wages, bonuses, etc., you would have made had you been able to work, you are entitled to have reimbursed. If your injuries are so severe that you may not work for years—or ever—then you will also be entitled to future lost wages. General damages are those that are much less easy to quantify, like pain, suffering, inconvenience, loss of enjoyment of life, stress, anxiety, and more. This can include actual physical pain that keeps you from working or doing tasks you once did on a daily basis, as well as emotional pain and trauma.

What if the Other Driver Doesn’t Have Insurance?

Although Arizona is one of many states that require all drivers to carry insurance, not all drivers do. It is common that the driver at fault is uninsured or underinsured, meaning that their policy limits are too low to cover the damage. The underinsured driver’s insurance will come into play first, then, your coverage. Typically, underinsured motorist coverage will only cover the motorist’s bodily injuries, meaning that it will only cover your medical bills. For these reasons, we recommend that you have uninsured/underinsured motorist coverage on your auto insurance policy.

How Long Will It Take My Personal Injury Claim to Settle?

While every Arizona personal injury claim is different, generally speaking, you can expect to receive your settlement check within 1 week after you have signed the settlement release and draft from the insurance carrier. You may receive your money in a lump sum settlement or as annuity payments, either monthly or annually.
